"미국 특허에 관한 기본 법률상식 그리고 지적 재산권의 중요성"
The legal protection provided by patents, as well as the basic criteria for patentability, are described. Some practical tips and guidelines are provided regarding the process of seeking patent protection for inventions. The 20 year patent battle fought by Gordon Gould, inventor of the laser, is used as an example that highlights some do’s and don’t’s of the patent procurement process. An overview of patent litigation is presented, by using case studies of high profile patent lawsuits such as Kodak v. Polaroid, and the recent Blackberry (RIM) v. NTP case. The critical role of claim construction in patent trials is explained. Patent-related decisions that were made by a number of industrial giants, and the resulting consequences, are described to convey the importance of adopting a strategic approach to patent portfolio development that aligns a company's patent strategy with its business goals.
특허 취득 요건 및 특허에 수반되는 법적 보호 범위, 그리고 발명자가 특허를 취득하기 까지의 과정에 대한 몇가지 실용적인 정보를 소개하였음. 레이저의 발명자인 Gordon Gould 씨의 20 년에 걸친 법정 투쟁을 예로 들어, 특허 취득 절차에 있어서 해야 할것과 해서는 안될 것 들을 사례로 보여줌. 특허 분쟁을 설명하기 위하여, Kodak v. Polaroid 그리고 최근의 Blackberry (RIM) v. NTP 등 널리 알려진 사례들을 소개했으며, 특허 분쟁에 있어서 용어 해석의 중요성이 강조되었음. 대기업들이 내린 특허에 관련된 결정들과 그로 인한 결과들을 통하여, 기업의 영업 목적에 부합되게 특허를 전략적으로 구축하여 기업의 경쟁력을 높인 경우와 그렇지 못한 경우를 보여줌.
Elizabeth Eunjoo Kim is a partner in the Intellectual Property Group of McDermott Will & Emery LLP. Her practice focuses on patent procurement and strategy, patent litigation and related counseling. Her experience encompasses a wide range of technical fields, including telecommunications, optics, nanotechnology, semiconductors, and image processing. Before entering law school, she worked as a physicist at research laboratories in France and Canada. She attended Seoul National University in Korea, and received a Ph. D. in physics and a J.D. from Stanford. She currently serves on the Board of Editors for the Boston Bar Journal of the Boston Bar Association.
김은주 특허 변호사는 현재 미국 맥더모트 윌 앤 에머리 로펌에서 지적 재산권 그룹의 파트너 변호사로 재직 중이다. 정보 통신, 광학, 나노기술, 반도체, 영상 프로세싱 등 다양한 기술 분야의 특허 획득 및 특허 분쟁 관련 업무를 담당하고 있다. 서울대 물리학과 재학중 3학년때 도미, U.C. 버클리 대학을 졸업하고 스탠포드 대학에서 물리학 박사학위를 받았다. 프랑스와 캐나다의 국립 원자력 연구소에서 핵물리 연구원으로 수년간 일한 후 스탠포드 법대에서 J.D.를 받았다. 현재 보스턴 변호사협회 월간지의 편집위원으로도 일하고 있다.
